Freedom of Information Publication Scheme

Section 8 of the Freedom of Information Act 2014 requires FOI bodies to prepare and publish as much information as possible in an open and accessible manner on a routine basis outside of FOI, having regard to the principles of openness, transparency and accountability as set out in Sections 8(5) and 11(3) of the Act.

This allows for the publication or giving of records outside of FOI provided that such publication or giving of access is not prohibited by law. The scheme commits FOI bodies to make information available as part of their normal business activities in accordance with this scheme.

Each link below leads to a page comprising relevant information in that category as well as links to relevant information on the Waterford City and County Council website. If the information you require cannot be found here, you may wish to contact our Freedom of Information Officer (+353 51 849572).

If the information is not currently made publicly available by Waterford City & County Council, you may then wish to consider making a Freedom of Information request.

What information can be accessed under FOI ?

Subject to exemptions, the Act gives right of access to the following records held by Waterford City & County Council:

  • All records created after the date the Act came into effect, 21 October, 1998.
  • Records created before that date if they are needed to understand records created after it.
  • Personal records, no matter when created.
  • Personnel records created from 21 October 2005 (three years before the Act came into effect) may be accessed by the individual to whom the records relate.

The Act does not apply to routinely available information, such as leaflets, public notices and publications advertised in the press. This information will continue to be freely available and so does not require access to be sought under Freedom of Information.

Information available under other legislation, such as planning and environmental information, is also excluded from the Freedom of Information Act. Your right to this information under other legislation will not change.
